This application is for grant of regular bail in connection with Dhamdaha P.S.Case No.226 of 2018 arising out CIS No.682 of 2018 dated 16.8.2018for the offences under Sections 366(A)/34 of the Indian Penal Code. Allegation against the petitioner is of trying to kidnap the daughter of the informant, aged about 16 years. Submission of the learned counsel for the petitioner is that as a matter of fact the marriage of the victim was to be solemnized with the petitioner, for which he did not agree; that is why he has been made accused in this case.

Heard learned A.P.P. also, who has opposed the prayer for bail stating that in her statement under section 164

Patna High Court Cr.Misc. No.63577 of 2018 (2) dt.25-10-2018 2/2 Cr.P.C. the girl has also supported the prosecution case. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, once the charge is framed against the petitioner in this case, the learned trial court shall release the petitioner on bail in connection with Dhamdaha P.S.Case No.226 of 2018 arising out of CIS No.682 of 2018 on an undertaking that he will co-operate in disposal of the trial and he will appear as and when required by the learned trial court. With the aforesaid observation, this application is disposed of.
