ANJANA MISHRA ORAL ORDER 29-06-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 16.10.2015 in connection with Itarhi P.S. Case No.236 of 2014, corresponding to Sessions Trial No.138 of 2016, registered for the offence under Sections 302, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that save and except the confession made by one Bikram Paswan, there is no further material to implicate the petitioner in any way. It is being further submitted that the petitioner has not been attributed any role and till date, he has not been placed on T.I. Parade. Patna High Court Cr.Misc. No.32254 of 2018 (3) dt.29-06-2018 2/3 this Court to Annexure 2 Series, by which similarly situated coaccused, namely, Sanjiv Mishra and Deepak Kumar Gupta, have been granted bail by this Court in Cr.Misc. No.9419 of 2015, vide order dated 24.04.2015, and Cr.Misc. No.21786 of 2015, vide order dated 08.09.2015.
In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Fast Track Court-1st, Buxar, in connection with Itarhi P.S. Case No.236 of 2014, corresponding to Sessions Trial No.138 of 2016, subject to the following conditions:
(1) One of the bailors will be the father of the petitioner.
(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.
(3) The petitioner shall remain physically present in court on each and every date during trial and in the event of his failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
(4) The petitioner shall co-operate with the
Patna High Court Cr.Misc. No.32254 of 2018 (3) dt.29-06-2018 3/3 investigation, if not already concluded, and make himself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail. (Anjana Mishra, J) PNM U T
