Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in connection Sahiyara P.S. Case no. 126 of 2020 registered for the offence punishable under section 30(a) of Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 06.02.2021 and is person with clean antecedent and charge sheet has been submitted. Allegation is of recovery of 79.500 liter country made foreign
Patna High Court CR. MISC. No.31190 of 2021(2) dt.26-11-2021 2/2 liquor from apprehend accused who disclosed the name of this petitioner who fled away. Learned counsel for the petitioner further submits that petitioner was not apprehended and his name was disclosed by co-accused.
Learned APP opposed the prayer for bail.
Considering the facts that petitioner is in jail custody since 06.02.2021 and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of the ADJ II-cum- Special Judge (Excise), Sitamarhi in Sahiyara P.S.
