JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-07-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 307, 506/34 and other allied sections of the Indian Penal Code and sections 25(1-B)(a), 27 and 35 of the Arms Act.
As per the prosecution case, on the alleged date and time of occurrence, 7 to 8 miscreants, covering their face with masks, riding on three motorcycles came and assaulted on the head of informant by butt of pistol. Out of them two co-accused Chotu Kumar and Md. Meraj were identified. while fleeing away co-accused Choto Kumar fired with his pistol. However no one sustained fire arms injuries.
Though petitioner is named in the FIR but there is no allegation of assault against him. He has been made accused in this case only on suspicion because of old enmity. No injury report is on the record.
Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned

No.21113 of 2023(2) dt.03-07-2023 2/2 above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Goraul (Kathara OP) Police Station Case No. 365 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
