JUSTICE SUDHIR SINGH ORAL ORDER 30-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code.
Allegation against the petitioners is to have assaulted brutally the informant and also snatched Rs. 5000/- from him. It has been submitted on behalf of the petitioners that they have no criminal antecedent. As per the prosecution case, the alleged time of occurrence is 11 in the night. No source of identification has been disclosed by the prosecution. Though petitioners are named in the F.I.R. but there is no allegation of assault against them. Allegation of assault is against other unknown persons.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.39739 of 2015 (2) dt.30-09-2015 2 / 2 above named petitioners, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Bhagalpur, in connection with Ishakchak P.S. Case no. 66 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
