The petitioner being the sister-in-law (brother's wife of the husband of the victim) is apprehending her arrest in a case registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

Accusation is of killing the daughter of the informant within one month of the marriage.

It is submitted by the learned counsel for the petitioner that the victim died due to Sun stroke and the father of the victim was present during cremation, but due to certain dispute which subsequently crept in the delayed F.I.R.

was lodged.

On completion of investigation the Final Form was submitted and petitioner was

Patna High Court Cr.Misc. No.39015 of 2015 (2) dt.01-10-2015 not sent up for trial, but differing with the Final Form, cognizance has been taken against the petitioner. It is further submitted that the father-in-law and the brother-in-law of the victim have been granted anticipatory bail vide Cr. Misc. No. 18176 of 2015 and Cr. Misc. 21290 of 2015 respectively. Considering the aforesaid facts, let the above named petitioner be released on bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Pauthu P.S. Case No. 46 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
