The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 and 308 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

It is a case of recovery of liquor from a motorcycle which was being driven by co-accused Mahesh Singh at the relevant time.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the vehicle in question was transferred by petitioner to co-accused Mahesh Singh through a written selling document duly sworn by co-accused Mahesh Singh which is

Patna High Court CR. MISC. No.22114 of 2022(2) dt.31-08-2022 2/2 annexed with the petition and he has no concern with the seized liquor and petitioner is a lady and she has clean antecedent. Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions as well as the fact that petitioner is lady, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Excise Court No.1, Siwan in connection with Basantpur P.S. Case No. 188 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
