JUSTICE SUDHIR SINGH ORAL ORDER 30-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 307, 120B/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioners is that they along with other accused fired at the informant, as a result of which he received fire arm injury in his stomach.

It has been submitted on behalf of the petitioners that they have no criminal antecedent. Allegation of assault is against Bhuna Mian, Fulmohammad Mian and Ram Nath Mahto. There is no allegation of assault made against the petitioners. F.I.R. has been instituted after two days for which prosecution has given no explanation.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

No.39742 of 2015 (2) dt.30-09-2015 2 / 2 Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri S. K. Srivastava, learned Judicial Magistrate, Ist Class, Raxaul at Motihari, in connection with Chhauradano P.S. Case no. 47 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
