The petitioners, who are in custody since 18.01.2020 and are persons of clean antecedents, seek bail in connection with Sabaur (Goradih) P. S. Case No. 19 of 2020 dated 18.01.2020 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It appears that 266 litres of liquor was recovered from a Maruti vehicle, from where the petitioners were arrested.

Patna High Court CR. MISC. No.19608 of 2020(2) dt.26-06-2020 2/2 Learned counsel for the petitioners has submitted that they are labourers and were being taken to a place for working for the master. The petitioners are neither the owner of the vehicle nor were in employment of the owner of the consignment of the liquor. In fact, the petitioners were completely unaware of the consignment of liquor in the boot of the car.

Regard being had to the nature of accusation and their period of custody, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge cum Special Judge (Excise Act), Bhagalpur or successor Court in connection with Sabaur (Goradih) P. S. Case No. 19 of 2020.
