JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Wajirganj P.S. Case No. 57 of 2014 registered for the offence under Sections-406, 420, 409 of the Indian Penal Code.

The petitioner is a rice miller and accusation against him is that he did not supply the rice as per the agreement, entered by him and accordingly, he embezzled huge government money.

The Photostat copy of the agreement has been filed as Annexure-6 to the supplementary affidavit and paragraph-15 of the aforesaid agreement reveals that

No.48085 of 2014 (3) dt.03-07-2015 2/2 parties were in agreement to file certificate case in case of any default in fulfillment of the terms, agreed upon between the parties. Moreover, it is informed that the certificate case has already been filed against the petitioner. Taking into consideration the aforesaid facts and circumstances of the case as well as submission of the parties, let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Wajirganj P.S. Case No. 57 of 2014 to the satisfaction of Learned Chief Judicial Magistrate, Gaya subject to conditions as laid down u/S 438(2) of the Code of Criminal Procedure.
