JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report and it appears from perusal of Para- 35 of the case dairy that the name of one Bhavesh Tanti came in this case on the basis of confidential information of the spy and, thereafter, co-accused Bhavesh Tanti was arrested and made his confessional statement disclosing this fact that this petitioner had hired him for committing murder of the deceased and, thereafter, he committed the murder of the deceased.

It appears from perusal of the entire case diary that except confessional statement of co-accused Bhavesh Tanti and Vikash, there is nothing against the petitioner, who being lady is

Patna High Court Cr.Misc. No.37711 of 2016 (3) dt.15-11-2016 2/2 languishing in jail custody since 20.04.2016 and the investigation against her has already been completed.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S.Case No. 330 of 2016.
