JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2018 The petitioner seeks regular bail in connection with Sasaram (Darigaon) P.S. Case No. 377 of 2018, registered for offences punishable under Sections 8(b), 18 of the NDPS Act. Allegation is that the police raided the house of the petitioner and wife of the petitioner was found with fruits of Afim and also disclosed that she had planted Afim plants over the area of 20 katha.

It has been submitted on behalf of the petitioner is that whatever allegation of recovery is there that is against the co-accused, who is wife of the petitioner and she has already been enlarged on bail by a coordinate Bench of this Court vide order dated 04.07.2018 passed in Cr. Misc. No. 28018 of 2018. Heard learned A.P.P. also.

No.64918 of 2018(2) dt.05-11-2018 2/2 Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Rohtas at Sasaram, in connection with Sasaram (Darigaon) P.S. Case No. 377 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
