2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act.

3 . It is alleged that 13.680 foreign liquor was recovered from possession of co-accused persons who disclosed the name of this petitioner.

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case on the basis of confessional statement of other co-accused persons. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner claims clean antecedent.

6. Considering the fact that no incriminating material has been recovered from conscious possession of this petitioner, clean antecedent and other circumstances of case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive special Excise Court No. 1 Katihar in connection with Telta Police Station Case No. 39 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
