This is a petition for grant of anticipatory bail for offence under Section 395 of the Indian Penal Code. According to first information report, some miscreants hired a tempo and, thereafter, snatched the same from the driver. Co-accused,, Vikas Kumar Mishra, was apprehended by the police and he confessed that the petitioner was also a coculprit. Submission of the learned counsel for the petitioner is that the petitioner has stated on oath that he has got no criminal antecedent and except confession there is no other material. The learned Sessions Judge, while refusing the prayer for anticipatory bail, has ordered for prayer for regular bail which shall be considered without being prejudiced by refusal of the anticipatory bail by the learned Sessions Judge.

Considering the fact that there is no substantial material against the petitioner, let the petitioner, above named, in the event of his arrest or surrender, within four weeks from the

No.17677 of 2017 (4) dt.14-07-2017 2/2 date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with Nautan P.S. Case No. 270 of 2015 to the satisfaction of Mr. N.P. Singh, Judicial Magistrate, West Champaran at Bettiah, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
