JUSTICE SUDHIR SINGH ORAL ORDER 24-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 328, 307 and 379 of the Indian Penal Code. Allegedly, the informant boarded in a tempo on Muzaffarpur Railway Station to go to Bairiya and in that tempo driver and three others were already boarded, but in the way, they provided cold drink, resulting the informant became senseless and his all articles including V.I.P. containing 15 sarees, soaps, Adhar Card, one bag rice, watch and two mobile were stole away. It has been submitted on behalf of the petitioner that the petitioner is in custody since 08.06.2016. Charge sheet has been submitted in this case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not

Patna High Court Cr.Misc. No.35434 of 2016 (3) dt.24-10-2016 2/2 named in the FIR. Except for the confessional statement of coaccused, there is no other substantive material to suggest the implication of the petitioner in the present case. Co-accused Amit Kumar @ Ashok Kumar and Rajesh Kumar have been granted bail vide Cr.Misc. No. 32065 of 2016.

On behalf of the State, it has been submitted that the petitioner is not named in the FIR.

Considering the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in connection with Brahampura P.S.Case No. 79/2016.
