JUSTICE SATYAVRAT VERMA ORAL ORDER 21-06-2022 The learned counsel for the petitioners submits that petitioner no.4 has been arrested during pendency of the anticipatory bail application and thus, seeks permission to withdraw the same.
Permission is accorded.
Heard learned counsel for the petitioners and the learned APP for the State.
The petitioner nos.1, 2, 3, 5 and 6 seek bail in
Patna High Court CR. MISC. No.22259 of 2022(2) dt.21-06-2022 2/3 anticipation of their arrest in a case registered for the offences punishable under Sections 147, 149, 188, 341, 353, 504 of the Indian Penal Code.
The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and alleges that Anita Devi @ Anita Singh was a candidate in the panchayat election and she along with her family members were creating obstruction and hindrance in due discharge of election duty being conducted by the Poling Officer. It is next alleged that informant tried to pacify the matter, but they continued causing obstruction in sealing the E.V.M. machine.
The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case. The allegation is of creating disturbance during poling of panchayat election, but the F.I.R. has not been instituted by the Poling Officer. It is next submitted that the family members of Anita Devi was made a scapegoat in the present F.I.R. by her adversary by taking police into confidence.
The learned Additional Public Prosecutor opposes the anticipatory bail application.
Considering the submissions made by the learned counsel for the petitioners and in the nature of allegation, the
Patna High Court CR. MISC. No.22259 of 2022(2) dt.21-06-2022 3/3 petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Patahi P. S. Case No.193 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
