2. The petitioner seeks regular bail in connection with Neemachandpura P.S. Case No. 161 of 2023 registered on 07.11.2023 lodged under Sections 366A of the I.P.C.

3. As per the prosecution case, F.I.R. has been lodged against the petitioner to whom there is an allegation that he had kidnapped the informant's daughter with a view to marry.

4. Counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 09.11.2023 having no case pending against him. He further submits that the alleged victim has been recovered and she has refused for medical examination. In her statement under Section 164 of the Cr.P.C., she has narrated that

5. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail and on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class-cum-Additional Munsif III, Begusarai in connection with Neemachandpura P.S. Case No. 161 of 2023 subject to the conditions laid down under Section 437 (3) of the Cr.P.C.
