This application is for grant of regular bail in connection with Sessions Trial No.702 of 2015 arising out of Beur P.S.Case No.292 of 2014, for the offences under Sections 363 & 365 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping a child and he was arrested at the spot on chase.

It is submitted on behalf of the petitioner that as the child was crying and in good faith, the petitioner held her for the purpose of searching out her parents, as such he has been falsely implicated in this case and he is in custody for since 20.12.2014. Heard learned A.P.P. also.

Having heard both sides and from perusal of the record, it

Patna High Court Cr.Misc. No.52920 of 2016 (3) dt.27-04-2017 2/2 appears that the court concerned and later on S.S.P., Patna have assured that they will take all steps for expeditiously conclusion of the trial.

In view of the above facts, this application is dismissed with a direction to the court concerned to expedite the trial and conduct it on regular basis. At the same time, the S.S.P., Patna is also directed to ensure attendance of witnesses in this case on the date as fixed by the court concerned so that it may be concluded within a period of nine months.

With the aforesaid observation, this application is dismissed.
