JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-12-2018 Heard counsel for the petitioners and counsel appearing on behalf of the State as well as the informant. The petitioners are apprehending arrest in connection with Patna City Chowk P.S. Case No. 326 of 2018 for offences under Sections 498(A), 323, 379/34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act. Learned counsel for the petitioners submits that the petitioners are family members of the husband of the informant. After marriage and birth of a male child the present
Patna High Court Cr.Misc. No.65628 of 2018(3) dt.17-12-2018 2/3 case has been filed in which the entire family members have been made accused including those who are not residing in the matrimonial house.
Having regard to the fact that the petitioners have no criminal antecedent and the fact that they undertake to maintain good relationship with the informant, the court is inclined to grant anticipatory bail to the petitioners. Let the petitioners, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Patna City, DistrictPatna in connection with Patna City Chowk P.S. Case No. 326 of 2018, subject to the conditions that they will maintain good relationship and there shall be no complaint from the informant and they will persuade the husband of the informant to restore matrimonial relation and keep the wife with full honour and dignity and further the conditions as laid down under Section 438(2) Cr. P. C.
