2. Petitioner seeks regular bail in connection with Runnisaidpur P.S. Case No. 761/ 2022 dated 15.12.2022 registered for the offence(s) punishable under Section(s) 341, 323, 307, 326, 504 read with section 34 of the IPC. Later on sections 304(B) and 302 of the IPC are added vide order dated 11.01.2024.

As per the prosecution's case, this petitioner and other accused persons firstly assaulted the victim and thereafter, other co-accused persons poured kerosene oil on her body and then the petitioner lit the matchstick and threw the same on her body as a result of which, she sustained burn injuries and later

The main submissions advanced by the petitioner's counsel are that the petitioner is father-in-law of the deceased, the deceased solemnized inter-caste marriage with the son of the petitioner in the year 2017 and her death took place in the year 2022 and in between the said period, there was no allegation against the petitioner by the deceased, in fact, the deceased accidentally sustained burn injuries while cooking food and later on, died during the course of medical treatment at SKMCH, Muzaffarpur. It is further submitted that the petitioner is an old person suffering from various diseases and he was living separately from his son at the time of alleged occurrence and he had no concern with the family affairs of his son and the deceased when the alleged occurrence is said to have taken place. It is further submitted that the petitioner has been languishing in custody since 29.08.2024 and investigation against him has been completed.

5. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

6. Heard both the sides and perused the FIR. The FIR is based on the fardbayan of the deceased and as per the allegation made by the deceased the accused persons, including

No.20915 of 2025(3) dt.30-04-2025 3/3 the petitioner, tortured her on account of her inter caste marriage with the son of the petitioner and on 08.12.2022, this petitioner and his family members came at her house and assaulted her and thereafter, other co-accused persons poured kerosene oil upon her body and the petitioner lit the light and set the victim on fire. The victim recorded her statement while in a burnt condition at SKMCH, Muzaffarpur and later on, she died.

7. Considering the seriousness of the allegation, this court is not inclined to release the petitioner on bail. Accordingly, his prayer stands rejected.
