The petitioner seeks bail in a case instituted under Sections 147, 148, 323, 379, 324 and 307 of the Indian Penal Code.

The allegation against the petitioner is that he along with others committed assault on the informant by knife and when the brother and nephew of the informant came to save him, they were also assaulted by the accused persons, causing injury to them.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.07.2016. The charge sheet has been submitted in the present case. The petitioner has got no

Patna High Court Cr.Misc. No.42177 of 2016 (2) dt.03-10-2016 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. General and omnibus allegation has been made against the petitioner. The nature of injury is simple. No offence under section 307 of the Indian Penal Code is made out against the petitioner.

On behalf of the state it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Manjhi P.S. Case No. 168 of 2016.
