JUSTICE ARUN KUMAR ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.

Petitioner apprehends her arrest in connection with Arer P.S. Case No.39 of 2016, registered under Sections 304(B) and 201/34 of the Indian Penal Code.

Allegation in brief is that the petitioner and her husband used to make further demand of dowry and torture the informant's daughter who was married with the petitioner's son in the year 2013. After getting information about illness of her daughter, the informant reached at her daughter's in-laws' house and found her dead body with burn injuries and the dead body was cremated.

Learned counsel appearing on behalf of the petitioner submits that petitioner is the mother-in-law and it was

Having considered the said facts and circumstances, this Court does not find it a fit case for grant of anticipatory bail. The prayer for anticipatory bail on behalf of the petitioner is rejected in connection with Arer P.S. Case No.39 of 2016, pending before the learned Judicial Magistrate, 1st Class, Benipatti, Madhubani.

However, the petitioner, if surrenders and seeks regular bail, the same shall be considered on merits without being prejudiced by this order.
