JUSTICE SANJAY PRIYA ORAL ORDER 06-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Mufassil P.S. Case No. 210 of 2018 instituted for the offence under Sections 302/34, 120-B of the Indian Penal Code and Section 27 of the Arms Act. As per allegation in the written report seven named accused persons including petitioner and some unknown persons have opened fire causing injury on the head of father of the informant, on account of which, he died.
Counsel for the petitioner submits that postmortem report has been enclosed as Annexure-2 wherein the Doctor has found one lacerated wound in inverted and irregular margin over occipital region of skull and one lacerated wound over right side of scalp. The Doctor has opined the cause of death due to
Patna High Court Cr.Misc. No.66284 of 2018 (2) dt.06-11-2018 2/2 haemorrhage and shock. Counsel for the petitioner further submits that other co-accused persons with similar allegation have already been granted bail by coordinate Benches of this Court vide orders dated 6.9.2018 and 29.10.2018 passed in Cr. Misc. 39211 of 2018 and 53128 of 2018 respectively. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate-V, Samastipur, in connection with Mufassil P.S. Case No. 210 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
