The petitioner is in custody in connection with Rafiganj P.S. Case No. 218 of 2018, registered for the offence punishable under Section 414 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Referring to the prosecution case, learned counsel for the petitioner submits that allegation of Section 414 I.P.C. is not attracted in this case. Learned counsel for the petitioner submits that petitioner is in custody since 07.12.2018.

Considering the fact that the petitioner has no criminal antecedent and has remained in custody for more than four months, the Court is inclined to grant bail to the petitioner. Let

No.26731 of 2019(2) dt.23-04-2019 2/2 the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No. 218 of 2018.
