====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 24-06-2023 Heard Ms. Manisha Prakash, learned counsel appearing on behalf of the petitioner and and Mr. Ajay Mishra, learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Khizersarai P.S. Case No. 27 of 2019, registered under Sections 409 and 420/34 of the Indian Penal Code. As per the allegation made in the F.I.R. is that petitioner had not handed over the merit-list application register, interaction register, interaction with the candidates and application form to the District Education Officer, Gaya. Learned counsel appearing on behalf of the petitioner submitted that petitioner is the Panchayat Secretary and he has no role in the selection of the Panchayat teacher of Khizersarai block. At the relevant point of time, the petitioner was posted at Imamganj block. The petitioner has clean

Learned A.P.P. for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner. Considering the nature of allegation made against the petitioner as well as the fact that the petitioner was not posted in the concerned block while the selection process of Panchayat Teacher was being done for the year 2003, at the relevant point of time, the petitioner was posted at Imamganj block. Let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-IV, Gaya in connection with Khizersarai P.S. Case No. 27 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
