Petitioner is accused in connection with S. Tr. No. 417/11 arising out of ghorasahan P.S. Case No. 134 of 2009 registered under Sections 302, 307, 147, 148 and 149 of the I.P.C. Learned counsel appearing on behalf of the petitioner submits that it would appear from the Postmortem Report that the deceased died due to head injuries caused by hard and blunt substance, while the allegation is of fire arm injury. Moreover, final form has been submitted in this case and petitioner is in custody since 07.06.2014. Further submission is that co-accused Satnarayan Rai @ Satya Narayan Rai has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 17909 of 2016.

No.42909 of 2016 (7) dt.18-03-2017 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Addl.Sessions Judge-14th, East Champaran at Motihari in connection with Sessions Trial No. 417/11 arising out of Ghorasahan P.S. Case No. 134 of 2009.
