Versus
The State of Bihar .... .... Opposite Party ====================================================== Appearance :
For the Petitioners : Mr. Mrityunjay Kumar For the Opposite Party : Mr. Sri Ram Naresh Ray ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 15-03-2017 Heard the parties.
The petitioners apprehend their arrest in Beldour P.S.Case No.276 of 2015, registered for offences punishable under Sections 387 & other Sections of the Indian Penal Code and Section 27 of the Arms Act.
The prayer for anticipatory bail of the petitioners was earlier rejected by order dated 21.07.2016 passed in Criminal Misc. No.21781 of 2016.
Learned counsel for the petitioners submits that since there was demand of extortion, therefore, the prayer for anticipatory bail of the petitioners was earlier rejected but from perusal of Annexure-3, by which a proceeding under Section 107
Patna High Court Cr.Misc. No.9991 of 2017 (2) dt.15-03-2017 2/2 of Cr.P.C. was initiated, it would appear that there is a land dispute between the parties. The allegation of extortion is false. Be that as it may, I do not find any fresh ground to consider the prayer for anticipatory bail of the petitioners. Accordingly, the same is rejected.
