2. The petitioner seeks bail in connection with Baheri P.S. Case No. 107 of 2024, instituted for the offences punishable under Sections 406, 420, 467, 468, 471 and 120(B) of the Indian Penal Code.
3. The prosecution case, in short, is that, the petitioner along with other co-accused person tricked the informant into opening a bank account and the accused also told her that she will get loan without any interest. It is further alleged that the
Patna High Court CR. MISC. No.20684 of 2025(3) dt.14-07-2025 2/3 accused persons misused her thumb impression and disbursed loan amount of Rs. 40,000/- in her name and later on threatened her over a fake loan.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. Learned counsel for the petitioner also submits that the petitioner has no manner of concern with disbursement of loan from the bank and it is well known that a bank only approves a loan or any amount after physical verification. It is further submitted that the petitioner is ready to pay 50 per cent of the amount i.e. Rs. 20,000/- to the informant. The petitioner is in custody since 10.11.2024 and has got one criminal antecedent.
5. Learned counsel for the informant has raised no objection if the petitioner is granted bail.
6. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court
Patna High Court CR. MISC. No.20684 of 2025(3) dt.14-07-2025 3/3 below/concerned Court in connection with Baheri P.S. Case No. 107 of 2024, subject to the following conditions: (I) The petitioner should pay Rs. 20,000/- to the informant by issuing Demand Draft at the time of furnishing bail bond.
(II) One of the bailors shall be own/close member of the family of the petitioner.
