JUSTICE MIHIR KUMAR JHA ORAL ORDER 12-01-2015 After some argument learned counsel for the petitioner realizing that the petitioner actually wants to enforce the terms of the contract and that too a non-statutory contract himself seeks permission to withdraw this application in order to enable the petitioner to file a civil suit and/or take recourse to arbitration proceeding.

Be that as it may, once the petitioner has realized that the writ application is not maintainable, he may take any other remedy as may be permissible in law.

That application is, accordingly, permitted to be withdrawn with the aforementioned liberty.
