Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 21.11.2017 passed in Cr.Misc.No. 52961 of 2017 and allegation against the petitioner is of recovery of 1 kg. Charas from rented house of Binda Sah and several persons have been named.

Submission of learned counsel for the petitioner is that petitioner is in custody for one year and other co-accused have been granted bail vide order dated 10.1.2018 in Cr.Misc.No. 52390 of 2017, vide order dated 2.2.2018 in Cr.Misc.No. 60430 of 2017 and vide order dated 1.2.2018 in Cr.Misc.No. 6340 of 2018 and petitioner is ready to abide by any condition that may be imposed on him if bail is granted.

Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-I-cumSpecial Judge, East Champaran, Motihari, in connection with N.D.P.S. Case No. 62 of 2017, arising out of Motihari Town P.S.Case No. 502 of 2017, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in disposal of trial and appear in court as and when required, otherwise his bail bond shall be cancelled.
