JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-05-2019 The petitioner seeks regular bail in connection with Muffasil P.S. Case No. 230 of 2018, registered for offences punishable under Sections 364/34 of the Indian Penal Code and later on Section 302 and 201 of the Indian Penal Code was added.
Allegation as per F.I.R. is that two named and three unknown persons kidnapped the brother of informant from the betel shop and later on his dead body was found. It has been submitted on behalf of the petitioner that he is not named in the F.I.R. and his name has surfaced on the confession of co-accused Gaurav Kumar, who has already been enlarged on bail by a coordinate Bench of this Court vide order dated 01.04.2019 passed in Cr. Misc. No. 3079 of 2019 and
Patna High Court CR. MISC. No.25300 of 2019(3) dt.22-05-2019 2/2 petitioner has been in judicial custody since 24.12.2018. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Muffasil P.S. Case No. 230 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
