JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-04-2019 The learned counsel for the petitioner submits that the petitioner has already filed a representation dated 16.03.2018 before the District Education Officer, Samastipur for issuance of appointment letter with regard to his appointment on the post of teacher on compassionate ground. The learned counsel for the petitioner further submits that though the petitioner has already been appointed as a Clerk under Class-III category on compassionate ground, however the claim of the petitioner is for appointment as a teacher, inasmuch as the petitioner fulfills all

It is further submitted that the petitioner would be satisfied, in case the District Education Officer, Samastipur is directed to consider the prayer of the petitioner for appointment on the post of teacher on compassionate ground and would pass a just and reasoned order within a stipulated time frame. Having regard to the facts and circumstances of the case, I deem it fit and appropriate to dispose of the present writ petition with liberty to the petitioner to file a fresh representation before the respondent no. 5 within a period of four weeks from today and the respondent no. 5 shall dispose of the same by a reasoned and speaking order within a period of eight weeks thereafter.
