The petitioner, who is in custody since 17.02.2020 and is a person of clean antecedent, seeks bail in connection with Maranchi P.S. Case No. 47 of 2017 dated 13.06.2017 instituted for the offences under Sections 302, 201 and 34 of the Indian Penal Code. The petitioner is not named in the FIR.

It has been submitted on behalf of the petitioner that with respect to the same occurrence which led to the death of the son of the informant, another case was lodged by the local Chowkidar vide Maranchi P.S. Case No. 46 of 2017. The petitioner was not named in that case also. In the aforesaid case

Patna High Court CR. MISC. No.19628 of 2020(4) dt.24-06-2020 2/2 lodged by the Chowkidar, one Subodh Singh was arrested who has confessed about the participation of the petitioner also. The petitioner was arrested on the basis of the aforenoted confession made in that case and has been sent in custody in the present case. The counsel laments that the petitioner has not yet been remanded in the case in which confession has been made.

However, regard being had to the period of custody of the petitioner and the nature of accusation against him, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Barh, Patna in connection with Maranchi P.S. Case No. 47 of 2017.
