2. The petitioner seeks bail in a case registered for the offence punishable under Section 366A/34 of the Indian Penal Code and Section 8 and 12 of the POCSO Act.
3. The allegation in the first information report is that while the informant's minor daughter went to ease herself, the F.I.R. named accused persons abducted her. When the daughter-in-law of the informant protested, co-accused, Anand Kumar @ Golu Kumar and Dilip Kumar assaulted her.
4. It is submitted by learned counsel for the petitioner that the name of the petitioner has surfaced in this

No.20726 of 2025(4) dt.18-06-2025 2/3 case on account of the fact that the petitioner happens to be the father of the said Anand Kumar against whom the allegation of kidnapping the informant's daughter has been alleged. Informant's daughter was having a love affair with the coaccused, Anand Kumar. She was subsequently recovered and her statement was recorded under Section 164 Cr.P.C. and, even according to her statement, she is aged about 19 years old. She eloped with Anand Kumar out of her sweet will and even married to Anand Kumar at Kerala. As per the statement of victim girl, her age is 19 years, hence no offence under the POCSO Act, in the facts of the present case, is made out. It is pointed out that co-accused, Shailesh Raut @ Savlesh Raut has already been granted the privilege of anticipatory bail by this Court vide order dated 11.04.2025 passed in Cr. Misc. No.1434 of 2025. The petitioner has no criminal antecedent and has been languishing in custody since 15.11.2024.
5. Learned APP for the State opposed the bail petition.
6. Taking into consideration the facts and circumstances of the case as also the statement of the victim girl recorded under Section 164 Cr.P.C., the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.
Patna High Court CR. MISC. No.20726 of 2025(4) dt.18-06-2025 3/3 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Kesariya P.S. Case No.136 of 2024.
