JUSTICE VIKASH JAIN ORAL ORDER 25-08-2015 After some arguments learned counsel for the petitioner seeks permission to withdraw the writ petition with liberty to prefer an appeal against the order dated 30.10.2013 passed in M.A. No. 283 of 2013 by the Debts Recovery Tribunal, Patna within a period of two weeks' hereof.
2. As prayed, the writ petition is permitted to be withdrawn and dismissed as such.
3. It is made clear that in case such an appeal is filed by
Patna High Court CWJC No.13099 of 2015 (3) dt.25-08-2015 the petitioner within two weeks' from today, he shall be at liberty to approach the appellate authority with a prayer for deferring the confirmation of auction sale scheduled to be held on 26th August, 2015 which may be considered and decided by the appellate authority in accordance with law.
