JUSTICE ANIL KUMAR SINHA ORAL ORDER 02-03-2022 Heard Mr. Ravi Ranjan, learned counsel for the petitioner and Mr. Akshay Lal Pandit, learned APP for the State. Petitioner seeks regular bail in connection with Brahmpura PS Case No. 237 of 2020 arising out of G.R. No. 4099 of 2020 registered for the offence under Section 386 / 506 of the IPC.

As per the first information report, the FIR named accused Taufi Yadav and Rocky Yadav used to demand extortion amount from the informant who was running business of motor parts for which an FIR bearing Brahmpura PS Case No. 310 / 2013 was lodged by the informant and due to non payment of extortion money, the brother of the informant was killed by Rocky Yadav, Taufi Yadav and others and an FIR bearing

Patna High Court CR. MISC. No.30436 of 2021(4) dt.02-03-2022 2/3 Brahampura PS case no. 244 of 2015 was lodged by the informant. It has been further alleged that in the case lodged by the informant for the murder of his brother , 3 - 4 witnesses have been examined and there is likelihood of the conviction of the accused persons named therein for which Taufi Yadav and Rocky Yadav have been pressurizing the informant for compromise and also demanding money.

Learned counsel for the petitioner submits that petitioner is not named in the FIR and has falsely been implicated in this case during the course of investigation on the material that the petitioner was seen moving on the road situated in front of the shop of the informant. Learned counsel submits that the road situated in front of the shop of the informant is a public road leading to his house and market places on which the petitioner travels frequently and except that the petitioner was seen moving on the road there is no allegation and material that the petitioner ever demanded money from the informant or pressurized him for compromise in a case lodged for murder of his brother. Learned counsel further submits that the named coaccused person Taufi Yadav has been granted bail by the Sessions Judge, Muzaffarpur in BP No. 857 / 2021 and the petitioner is in custody since 15 -01- 2021.

No.30436 of 2021(4) dt.02-03-2022 3/3 Regard being had to the submissions made by the parties, taking into consideration the fact that petitioner is not named in the First Information Report, he is in custody since 15 / 01 / 2021, charge sheet has already been submitted and the coaccused person has been granted bail by the court below itself, as such, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- ( twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Muzaffarpur / concerned court in connection with Brahmpura PS Case No. 237 of 2020 arising out of G.R. No. 4099 / 2020 on the following condition:- (a) that the petitioner shall remain present on each and every date during the trial and in case of absence on two consecutive dates without prior permission of the trial court, his bail bond shall liable to be cancelled.
