JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-05-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 366A/34 of the Indian Penal Code.

Allegation against the petitioners is that they have enticed the daughter of the informant away. On repeated requests they did not return his daughter and after some time she came back on her own.

Heard learned counsel for the petitioners.

It has been submitted on behalf of the petitioners that as a matter of fact there was love affair between the son of the petitioners and the victim girl. Petitioners are father and mother of the boy and they have been made accused just to know whereabout of their son and daughter of the informant.

Having heard both sides, in view of the facts and circumstances of the case, let above named petitioners shall surrender in the court below, i.e., Judicial Magistrate, Ist Class, Danapur, within a period of three weeks and court below shall release the petitioners on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) each with two sureties of the like amount each to its satisfaction in connection with Ranitalab P.S. Case no. 104 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also subject to the conditions that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioners shall cooperate in the investigation and make themselves available before the police as and when required.
