JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 07-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor In paragraph 9 of Cr. Misc. No.21828 of 2012 petitioner had averred "that there is no criminal antecedent of the petitioner in any P.S. record" and further taking into account the submission made on behalf of petitioner, while granting bail vide order dated 12.06.2012 it has been observed "It is further directed that before acceptance of bail bond, the learned Special Judge will ascertain criminal antecedent of the petitioner. In case the same is traced out, then in that event the effect of the order impugned will evaporate."

Now by way of filing of Cr. Misc. No.50297 of 2014 petitioner has prayed for modification of aforesaid part of order in the background of the fact that petitioner happens to be an accused in Tajpur P.S. Case No.208 of 2005. The aforesaid event has purposely been withheld at an earlier

Patna High Court Cr.Misc. No.50297 of 2014 (2) dt.07-01-2015 occasion and on account thereof, for the present, I do not see it a good ground to re-adorn. Accordingly, Cr. Misc. No.50297 of 2014 is rejected.
