JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-12-2018 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Bathnaha P. S. case no. 218/2018 registered under sections 379, 427, 504 and 506/34 of the IPC.

Petitioners are named in the first information report on the allegation that they as well as others cut mango trees from the filed of the informant. However, it is informed on behalf of the petitioners that co-accused Md. Khalid, who happens to be agnate of the informant, has already been granted privilege of anticipatory bail by a co-ordinate bench of this court and the case of these petitioners stands to the similar footing to that coaccused Md. Khalid.

No.68510 of 2018(2) dt.17-12-2018 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Bathnaha P. S. case no. 218/2018 subject to condition as laid down under section 438(2) of the Cr.P.C.
