2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 302 and 34 of the Indian Penal Code and Section 27 of Arms Act.

3. As per the prosecution case , co-accused Ramanand Malakar fired upon the deceased (father of the informant) due to which he died.

4. Learned counsel for the petitioner submits that it was co accused Ramanand Malakar who shot dead the father of the informant and so far as this petitioner is concerned, there is no allegation of assault against him.

5. Learned counsel for the State opposes the bail

Patna High Court CR. MISC. No.27473 of 2024(3) dt.03-07-2024 2/2 petition of the petitioner.

6. Considering the fact that there is no allegation of any assault against this petitioner and other circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Rosera District Samastipur in connection with Bibhutipur P.S. case No. 04 of 2006 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
