The petitioner seeks bail in Khutauna P.S. Case No. 67/2018, instituted for the offences under Sections 399, 402, 414, 506 and 120(B) of the Indian Penal Code read with Sections 25(1b) A, 26 and 35 of Arms Act. It is alleged in the written report that police on getting confidential information that few miscreants have assembled for committing crime reached the aforesaid place. Seeing the police party, 5 miscreants started running away on motorcycle, but on chase the petitioner and other miscreants were apprehended.
Learned counsel for the petitioner has submitted that
Patna High Court Cr.Misc. No.65626 of 2018 (2) dt.05-11-2018 2/2 there is no recovery of any incriminating article from possession of this petitioner. It is alleged that one loaded country made pistol with a live cartridge were recovered from possession of Amrit Kumar @ Gopi. Petitioner is in custody since 12.06.2018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate IIIrd, Jhanjharpur, Madhubani in connection with Khutauna P.S. Case No. 67/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J.) Rakhi U T
