Petitioner seeks bail in Mushahari P.S. Case No.161 of 2018 instituted for the offence under Section(s) 414/34 Indian Penal Code.
It is alleged that police on suspicion that two persons, namely, Md. Nizam and Md. Sahmad have stolen vehicle, have rushed for vehicle checking and found one white coloured pickup van in Bhandari Gas Building. One person was found sitting on the driver seat and another person jumped to run away. The police arrested one person, who disclosed his name as petitioner. Another person managed to run away. Counsel for the petitioner submits petitioner has
Patna High Court Cr.Misc. No.66239 of 2018 (2) dt.06-11-2018 2/2 been arrested merely on suspicion. He was just sitting on the pickup van. He had no knowledge that the vehicle is stolen and driver of the vehicle had fled away.
Petitioner is in custody since 09.07.2018.
Keeping in view the period spent by the petitioner in custody, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, VI, Muzaffarpur, in connection with Mushahari P.S. Case No.161 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) JA/- U T
