Petitioner, who is in custody, seeks bail in connection with Special Excise Case No. 839 of 2018 arising out of Bhawanipur P.S. Case No. 190 of 2018 registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and under Section 30(a) of Bihar Prohibition and Excise Act.

Allegation against petitioner is that from the bottom of seat of Tempo 18.003 liters of liquor has been recovered.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been

Patna High Court Cr.Misc. No.67374 of 2018(2) dt.27-11-2018 2/2 falsely implicated in this case due to village politics. Petitioner stated that he was passenger and nothing to deal with seize liquor. He has no criminal antecedent. He is in custody since 18.09.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Purnea in connection with Special Excise Case No. 839 of 2018 arising out of Bhawanipur P.S. Case No. 190 of 2018.
