Mr. K.K.Sinha has appeared on behalf of the respondent State Bank of India ( for short 'the Bank').

The writ application questions the legality of the notice dated 1/2 of February, 2011 issued by the authorized Officer of the Bank under Section 13(2) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 ( for short 'the Act') as the loan account was classified as NPA. The petitioner was guarantor of the loan.

It has rightly been pointed out by Mr. Sinha that if the petitioner is aggrieved by the notice issued under section 13(2) of the Act, she could have filed an objection before the authorized Officer

Patna High Court CWJC No.14894 of 2011 dt.15-09-2015 2/2 within 60 days of the receipt of the notice. The same does not appear to have been filed.

The writ application is dismissed.
