2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act.
3 . It is alleged that 13.4 liters of mahua liquor was recovered from wooden ply near shop of this petitioner.
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery . Petitioner has got 2 criminal antecedent out of which 1 is of similar nature . 5 . Learned counsel for the State opposed the bail

Considering the aforesaid facts and other circumstances of case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned special Judge Excise II Patna in connection with Kadamkuan Police Station Case No. 53 of 2021 , subject to the conditions laid down under section 438 ( 2 ) of Code of Criminal Procedure .
