JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302, 279/34 of the Indian Penal Code and 27 of the Arms Act.

Although the petitioner is named in the first information report but the allegation of opening fire is against coaccused, Dileep Yadav. The learned Additional Public Prosecutor fairly, conceded this fact that no specific overt act is said to have been committed by this petitioner.

Learned counsel, appearing for the petitioner informed that one co-accused Rajesh Yadav, having more or less

Considering the above-said facts and circumstances of the case as well as submission of the parties and also, taking note of this fact that the petitioner does not have any criminal antecedent, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sonbarsa Raj P.S. Case No. 86 of 2015 to the satisfaction of Sri S. K. Jha, learned Judicial Magistrate-Ist Class, Saharsa. (Hemant Kumar Srivastava, J) A.K.V./- U T
