JUSTICE SANDEEP KUMAR ORAL ORDER 27-06-2023 This application has been filed for quashing the F.I.R. of Raghunathpur P.S. Case No. 193 of 2019 instituted for the offences under Section 304(B)/34 of the I.P.C. As per the prosecution case, the daughter of the informant was married with the Brother of the petitioner namely Sanjeet Kumar on 25.06.2018 and the family member of the petitioner demanded Rs. 2,00,000/- and one Motorcycle as dowry and due to non-fulfillment of alleged demand of dowry, daughter of the informant was killed.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and she is the sister-in-law of the deceased and she is residing separately at her
Patna High Court CR. MISC. No.22020 of 2022(2) dt.27-06-2023 2/2 matrimonial house.
Considering the allegations levelled against the petitioner, I am not inclined to quash the F.I.R. registered against the petitioner under Section 304(B)/34 of the I.P.C. In view of the law laid down by the Hon'ble Supreme Court in the case of Neeharika Infrastructure Pvt Ltd. V. State of Maharshtra and others (2020) 10 SCC 118, this application is dismissed.
If chargesheet is submitted against the petitioner, the petitioner has liberty to approach this Court at subsequent stage.
This application stands dismissed.
