JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-07-2020 Heard Mr. Dinesh Jha, learned counsel for the petitioner and Mr. Narsingh Tanti, learned APP for the State. The petitioner, who is the elder brother of the husband of the informant, seeks bail in connection with Bajpatti P.S. Case No. 52 of 2020, dated 08.02.2020, instituted for the offences under Sections 341, 323, 354, 307, 325 and 34 of the Indian Penal Code.
The petitioner is stated to be in custody since 16.02.2020 and has clean antecedent.
The allegation against the petitioner is of having dragged the informant and of assaulting her children. It has been submitted on behalf of the petitioner
Patna High Court CR. MISC. No.21569 of 2020(2) dt.07-07-2020 2/2 that the injuries suffered by the informant and her children are not of the nature which can give an impression that any attempt was made on her life. It has further been submitted that the allegations have been exaggerated for the reason that there is a family dispute between the parties and a partition suit is also pending before the competent Court of law.
Considering the facts afore-stated and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri at Sitamarhi in connection with Bajpatti P.S. Case No. 52 of 2020.
The application stands allowed.
