2. The petitioner is apprehending his arrest in connection with Gandhi Maidan P.S. Case No. 431 of 2023 for the offence under Sections 379 and 420 of the I.P.C.

3. As per the prosecution story, the informant has alleged that the petitioner is working as accountant in his company and in the month of November, 2022, he embezzled a total amount of Rs. 3,68,000/- from the collection of the company.

4. Learned counsel for the petitioner submits that petitioner is totally innocent and has not committed any such offence alleged in the F.I.R. and has been falsely implicated in the present case. No occurrence as alleged by the prosecution ever took place. Petitioner is working as an accountant and his

Patna High Court CR. MISC. No.25489 of 2024(6) dt.05-03-2025 2/2 scope of work never included recovery of amount from the clients of the informant's company. The petitioner did not work as recovery executive. The petitioner never received any money from the client of the informant's company.

5. Learned counsel for both the parties have jointly submitted that this case has been settled amicably between the parties.

6. Taking into account the fact that the matter has amicably been settled between the parties, this Court is inclined to extend him the privilege of anticipatory bail.

7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned S.D.J.M., Patna, in connection with Gandhi Maidan P.S. Case No. 431 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (S. B. Pd. Singh, J) Ankit Kumar/- U T
