JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 Petitioner seeks regular bail in connection with Danapur (Shahpur) P.S. Case No.404 of 2003, Sessions Trial No.646 of 2005 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code. This case is of misuse of privilege of bail for a period of 23 months.
Submission of the learned counsel for the petitioner is that he is in custody since 03.09.2018 and he could not appear before the trial court as he was out of State and he is ready to abide by the conditions imposed upon him.
Heard learned A.P.P. also.
Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named,
Patna High Court CR. MISC. No.19034 of 2019(3) dt.21-05-2019 2/2 be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions JudgeII, Danapur, in connection with Danapur (Shahpur) P.S. Case No.404 of 2003, Sessions Trial No.646 of 2005, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with the condition that he has to appear before the trial court as and when required, otherwise his bail bonds is cancelled.
